Actual text? Hard to make heads or tails of this mess.[edit]

There's a Text section that says "as proposed by", but it doesn't say this is the actual text. I *assume* it is, but…

Then there's the following section that says "His draft language that later became the Fifth Amendment" which first makes one think it is the text but then says it was edited. --jae (talk) 11:13, 20 February 2018 (UTC)[reply]

The whole section of the text is draft and doesn't represent actual law, but history of only 1788 congress. This is a joke, and apparently designed to disinform. Cmahte (talk) 16:12, 18 November 2020 (UTC)[reply]

Clarification regarding the application of Due Process[edit]

Unless I am reading this incorrectly, the introductory statements seem to include a contradiction regarding the application of Due Process. The third sentence of the first paragraph reads, "The Fifth Amendment applies to every level of the government, including the federal, state, and local levels, in regard to a US citizen or resident of the US."

However, the second sentence of the third paragraph reads, "The Fifth Amendment's due process clause applies to the federal government, while the Fourteenth Amendment's due process clause applies to state governments."

Reading these two statements together, I am unsure whether the Fifth Amendment's due process applies only to the federal government, or also to state and local governments. If there are two separate provisions within the Fifth Amendment, one of which applies to all levels and another which applies only to federal, I feel that this should be explicitly stated to avoid confusion. Otherwise, the description of the Amendment's application should be adjusted.

14th Amendment is just reiteration of the Constitution. It's an act of saying State can not bar what's established in the US Constitution. States get their authority from the US Constitution and therefore must also follow the US Constitution, even if they draw up their own State Constitution. 73.225.182.47 (talk) 10:01, 9 August 2021 (UTC)[reply]

Correct English language?[edit]

The first sentence currently reads: „The Fifth Amendment (Amendment V) to as part of the Bill of Rights.“

„to as part of“ doesn’t seem to make sense, but I’m not a native English speaker, so I might just not know this strange language construction. 217.251.251.109 (talk) 06:23, 14 November 2022 (UTC)[reply]

It was vandalized twice recently; a small deletion in September much bigger deletion two days ago. Unfortunately, active WP editors are spread way too thin right now, especially on legal articles, because the Wikimedia Foundation's incompetent management drives away so many editors.
